FairFlo Beta Program Agreement

This Beta Program Agreement (the "Beta Agreement") governs your participation in the FairFlo beta program. It is between Ikigai Holdings Corporation, doing business as FairFlo ("FairFlo," "we," "us," or "our"), and the organization participating in the beta ("you"). It supplements the FairFlo Terms of Service and Privacy Policy, which continue to apply in full. If there is a conflict between this Beta Agreement and the Terms of Service with respect to beta access, this Beta Agreement controls for the beta features.

By accepting this Beta Agreement, or by accessing or using the beta, you agree to it. Capitalized terms not defined here have the meaning given in the Terms of Service.

1. Beta Access

We are giving you early access to FairFlo, or to specific pre-release features (together, the "Beta"), so you can try it and give us feedback. Access may be free or discounted for the beta period. We decide who participates and may change or end your access at any time.

2. Pre-Release, Provided "As Is"

The Beta is pre-release and still in development. It may be incomplete, may contain errors, and may behave unexpectedly. The Beta is provided "as is" and "as available," without warranties of any kind, and without any service-level or uptime commitment. Beta features may be changed, suspended, or removed at any time without notice, and may never become generally available.

3. No Guarantee of Results

We do not guarantee any outcome from the Beta, including message delivery, inbox placement, response rates, retailer engagement, sales, reorders, or retention, and we do not guarantee that your Connected Accounts will not be restricted by their providers. You use the Beta and any AI-drafted outreach at your own risk and remain responsible for reviewing and approving what is sent.

4. Your Data During the Beta

Beta environments may be reset, and beta data may be changed or deleted, as we develop the product. We will handle your data as described in the Privacy Policy and, where we act as your processor, the Data Processing Addendum. We do not guarantee export of beta data or that beta data will carry over if you later move to a paid plan. As with the paid Service, we do not sell your data, do not share it with your competitors or other customers, and do not use it to train AI models.

5. Feedback

We would love your feedback. Any feedback, ideas, or suggestions you give us about the Beta are given freely, and you grant us a perpetual, irrevocable, worldwide, royalty-free license to use them without restriction or attribution. Feedback is not confidential to you, and giving it does not entitle you to any payment or ownership in FairFlo.

6. Confidentiality

The Beta and any non-public information you learn through it (including unreleased features, roadmaps, and performance) are our confidential information. Please do not publicly disclose, screenshot, benchmark, or write about non-public Beta features without our prior written consent. This does not restrict you from describing your own general experience once a feature is publicly released.

7. Testimonials and Case Studies

We will not use your name, logo, or a testimonial or case study about your participation without your prior consent. If you agree to participate in a case study, we will confirm the scope with you first.

8. Term and Changes

The Beta period continues until we end it, convert it to a paid offering, or you stop participating. We may end the Beta, or your participation, at any time and for any reason. If we transition the Beta to a paid plan, we will give you reasonable notice and the choice to subscribe or stop; we will not start charging you without your authorization.

9. Everything Else

All other terms of the Terms of Service and Privacy Policy apply to your Beta participation, including the sections on acceptable use, AI features, limitation of liability, indemnification, and dispute resolution. This Beta Agreement is governed by the same law and dispute-resolution terms as the Terms of Service.
